Terms of Service

1. Agreement

By adding FormBot to a Discord server or using the FormBot web dashboard (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must comply with Discord's Terms of Service and Community Guidelines when using FormBot.

2. Eligibility

You must be at least 13 years old (or the minimum age required by Discord in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

3. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation
Harass, abuse, threaten, or harm any person
Collect or process personal data without appropriate consent
Spam members with unsolicited messages or forms
Attempt to gain unauthorised access to the Service or its infrastructure
Reverse engineer, decompile, or scrape the Service
Use the Service to operate a competing bot management platform
Distribute content that is illegal, hateful, or otherwise objectionable

We reserve the right to terminate access to the Service for any user or server that violates these rules, at our sole discretion, without prior notice.

4. Free Plan

FormBot offers a free plan with usage limits (number of forms, panels, poll options, ticket categories, etc.) as described on the pricing page. The free plan is provided "as is" with no uptime guarantees. We reserve the right to modify or discontinue the free plan at any time with reasonable notice.

5. Premium Subscriptions

Premium plans are billed monthly per Discord server via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel at any time via the dashboard or by contacting support. Cancellation takes effect at the end of the current billing period — you retain Premium access until then.
Refunds: Subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 14 days.
Price changes: We will give at least 30 days' notice before increasing subscription prices. Continued use after the notice period constitutes acceptance of the new price.
Failed payments: If payment fails, Premium features will be suspended until payment is resolved. We will notify you via the email on your account.

6. Intellectual Property

FormBot and all related software, designs, and trademarks are owned by us. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your Discord server.

Form submissions, ticket content, and other data you create remain your property. You grant us a limited licence to store and process that data solely to operate the Service.

7. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.

8. Availability and Changes

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the Service at any time. For Premium subscribers, we will provide at least 14 days' notice of any discontinuation.

We may update these Terms at any time. We will notify users of material changes via our support server or email. Continued use after the effective date of updated Terms constitutes acceptance.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of Belgium, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Belgium, unless applicable consumer protection law in your jurisdiction provides otherwise.
